Conflict of Interest Policy Pack

Conflicts of interest are present in every organisation, and RTOs are no exception. The relationships between assessors and students, between management and staff, between governance and business decisions, and between your RTO and its commercial partners all create situations where personal or financial interests can influence, or appear to influence, professional judgements. The risk is not simply that a conflict exists. The risk is that it is not identified, disclosed, or managed in a way that protects the integrity of your RTO's decisions and the trust of your students and stakeholders.

 

The Standards for RTOs 2025 require your RTO to have documented processes for identifying and managing conflicts of interest across all aspects of its operations. This obligation is particularly acute in assessment, where the requirement for impartial, evidence-based judgement is fundamental to the validity of the competency decisions your assessors make. An assessor who has a personal relationship with a student, a financial interest in an outcome, or a management relationship that creates pressure to pass or fail a particular candidate must have a clear, documented process for declaring that conflict and stepping back from the assessment decision. Without that process, the integrity of your assessment system is compromised in a way that is difficult to defend during audit or in response to a complaint.

 

Conflict of interest obligations extend beyond assessment to governance, procurement, staff management, and marketing. Any decision-making process in your RTO where a personal or financial interest could influence the outcome requires the same structured approach: identify, disclose, assess, and manage. This policy pack gives your RTO the documented framework to do that consistently across your entire operation. When implemented, it supports compliance with clause 4.3 of the Standards for RTOs 2025, as well as the associated Compliance Requirements.
